Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and eVaqil governing your use of the eVaqil.com website, mobile applications, and related services (together, the "Service"). By signing in, completing OTP verification, or using any part of the Service you confirm that you have read, understood, and agree to these Terms together with the Privacy Policy. If you do not agree, you must not use the Service.

1. About eVaqil and how it should be understood

eVaqil.com is a practice-management and workflow tool intended for advocates, judicial clerks, paralegals, law students, and other legal professionals practising primarily before Indian courts and tribunals. It helps users organise case data, hearings, documents, reminders, and communications.

eVaqil is a service provider and intermediary. The Service is not a law firm, does not provide legal advice, and does not establish an attorney–client relationship between you and eVaqil. Nothing in the Service is a substitute for independent professional judgment.

Consistent with Rule 36 of the Bar Council of India Rules, the Service is not a vehicle for soliciting professional work on behalf of advocates. Features such as the advocate directory exist to help legal professionals discover and contact one another for collegial, referral, or professional collaboration purposes — not to advertise services to non-advocate prospective clients.

2. Eligibility and acceptance

  • You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
  • If you are using the Service in a professional capacity, you confirm that you are duly enrolled, qualified, or otherwise authorised to perform that role under applicable law.
  • If you accept these Terms on behalf of a firm or organisation, you confirm that you are authorised to bind that entity, and references to "you" include both you and that entity.

3. Account, authentication, and security

Access to the Service requires a verified Indian mobile number. Verification is performed via one-time password (OTP) delivered by SMS or by demonstrating possession of an existing session.

  • You must use a mobile number you own or are authorised to use.
  • Do not share your OTP, device, or session with anyone else. Actions taken from a verified session are deemed to be your actions.
  • If you suspect unauthorised access, sign out from all devices, request a new OTP, and notify support@evaqil.com immediately.
  • We may suspend, throttle, or revoke access where we reasonably suspect compromise, fraud, abuse, or violation of these Terms.

4. Permitted use

You may use the Service to:

  • Manage your case list, hearings, parties, documents, notes, and reminders.
  • Look up publicly available case information through integrations with eCourts and related public systems.
  • Generate cause lists, summaries, hash reports, and other working documents from your own data.
  • Communicate with other verified advocates through directory and broadcast features for lawful professional purposes.
  • Submit feature requests, jobs, and feedback through the channels we provide.

5. Prohibited use

You agree not to, and not to permit any other person to:

  • Use the Service for any unlawful purpose, or to violate any applicable court order, statutory rule, regulator direction, or professional rule of conduct.
  • Access, attempt to access, scrape, harvest, or interfere with another user's account, data, or device.
  • Reverse engineer, decompile, copy, modify, or create derivative works of the Service, except where such restriction is prohibited by law.
  • Use the Service to solicit professional work in a manner that contravenes the Bar Council of India Rules or analogous regulator rules.
  • Upload content that is unlawful, defamatory, obscene, infringing, malicious, or that contains malware, viruses, or other harmful code.
  • Use automated systems (bots, crawlers, headless browsers, scripts) to interact with the Service except where we expressly enable it through documented APIs.
  • Send unsolicited bulk messages, marketing solicitations, or any communication prohibited by the Telecom Commercial Communications Customer Preference Regulations, 2018 or other applicable rules.
  • Mis-state your identity, professional qualification, or authority on the Service.

6. eCourts and third-party public data

Case details, cause lists, orders, judgments, party information, and similar records shown in the Service may be retrieved from public court systems including the eCourts Services portal, court-complex micro-sites, and analogous sources. eVaqil does not control these sources, does not warrant their accuracy or availability, and is not responsible for delays, gaps, errors, or downtime in them.

You must independently verify any time-sensitive or determinative information — including hearing dates, listing details, orders, and deadlines — directly from official court records before acting on it.

7. AI features and assistive tools

Certain features (including, where enabled, summarisation, drafting suggestions, extraction of fields from documents, and the "AI Clerk") use machine-learning models that may be operated by third-party providers. For these features the content you submit, or content fetched on your behalf, may be transmitted to those providers solely to generate a response.

  • AI output is generated automatically and can be incorrect, incomplete, or out of date. Treat it as a starting point, never as legal advice or as a substitute for reading the source material.
  • Do not submit privileged or confidential information into AI features unless you have lawful authority and a basis under your professional obligations to do so.
  • On-device tools (such as on-device OCR, PDF compression, and the MD5 hash generator) operate locally on your device and do not transmit the underlying files to eVaqil or third parties unless you choose to share the output yourself.

8. Electronic-evidence hash generator

The Service offers a tool that computes MD5 hashes for files on your device and exports an evidence-style report. The tool is intended to assist with chain-of-custody documentation under S. 63 of the Bharatiya Sakshya Adhiniyam, 2023 but does not, by itself, constitute a certificate or attestation. Whether a hash, report, or any accompanying certificate is admissible or sufficient in a given proceeding is for the competent court and the practitioner to determine.

9. User content, communications, and uploads

You retain ownership of the case data, notes, documents, broadcasts, job postings, and other content you create, upload, import, or transmit through the Service ("User Content").

You grant eVaqil a worldwide, royalty-free, non-exclusive licence to host, store, copy, process, transmit, render, and otherwise use your User Content solely to provide and operate the Service for you, to perform backups, to enforce these Terms, and to comply with applicable law. This licence terminates when you delete the relevant User Content from the Service, subject to reasonable operational lag, backup cycles, and legal-hold obligations.

You are solely responsible for your User Content and for ensuring you have the right to submit, share, or process it through the Service. Do not upload material whose disclosure you are not authorised to make.

10. Push notifications and contact

The Service uses push notifications and, where you opt in, SMS for hearing reminders, security alerts, and product communications. You can manage notification permissions in your device settings and through the in-app notification controls. Operational and security alerts may continue even when product communications are disabled.

11. Fees, subscriptions, and changes to pricing

The core Service is currently offered without charge. eVaqil may introduce paid features, plans, or transaction-based fees in the future. Where a feature is paid, the fees, billing cycle, taxes, refund terms, and any usage limits will be disclosed at the point of purchase, and your continued use of the paid feature confirms acceptance of those additional terms.

12. Intellectual property

The Service, including its software, source code, design, branding, content (other than User Content), and the eVaqil.com marks, is owned by eVaqil and its licensors and is protected by copyright, trade mark, and other applicable laws. Nothing in these Terms transfers ownership of these rights to you. You receive only a limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

13. Third-party services

The Service integrates with third-party services for hosting, messaging, notifications, analytics, and assistive features. Those services are governed by their own terms and privacy notices, and eVaqil is not responsible for their conduct or content. The Privacy Policy lists the categories of third parties we engage and the data shared with them.

14. Service availability; no warranty

The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, eVaqil disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted operation, and freedom from defects or harmful code.

eVaqil does not warrant that the Service will be available at any particular time, that data fetched from third-party sources will be timely or accurate, that AI-generated output will be correct, or that reminders and notifications will be delivered without delay or omission.

15. Limitation of liability

To the maximum extent permitted by law, eVaqil, its officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data, or use; loss of any opportunity (including a professional or litigation opportunity); or loss resulting from missed deadlines, missed hearings, or inaccurate court data, arising out of or related to your use of, or inability to use, the Service.

eVaqil's total aggregate liability arising out of or related to the Service, regardless of the form of action, will not exceed the greater of (a) the total amount you paid to eVaqil for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) INR 1,000.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable Indian law.

16. Indemnity

You agree to defend, indemnify, and hold harmless eVaqil and its officers, employees, contractors, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to (i) your use of the Service, (ii) your User Content, (iii) your breach of these Terms or applicable law, or (iv) your violation of any third-party right.

17. Suspension and termination

You may stop using the Service at any time. eVaqil may suspend or terminate your access where you breach these Terms, where required by law or court order, where continued access poses a security, integrity, or operational risk, or where the Service (or any feature within it) is discontinued.

Upon termination, sections of these Terms that by their nature should survive will survive, including provisions on intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.

18. Changes to the Service and to these Terms

We may change, add, or remove features at any time. We may also amend these Terms; when we do, we will update the "Last updated" date at the top of this page and, where the changes are material, take reasonable steps to bring them to your attention. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

19. Governing law and dispute resolution

These Terms are governed by the laws of India without regard to its conflict-of-laws principles. The courts at New Delhi, India shall have exclusive jurisdiction over any dispute, controversy, or claim arising out of or in connection with these Terms or the Service, subject to any mandatory consumer-protection rights you may have at your place of residence.

20. Grievance Officer (IT Rules 2021)

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, complaints may be addressed to the Grievance Officer:

We will acknowledge complaints within 24 hours and resolve them within 15 days of receipt, as required by law.

21. Miscellaneous

  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
  • Waiver. No failure or delay by eVaqil in exercising any right under these Terms is a waiver of that right.
  • Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a reorganisation, merger, sale of assets, or change of control.
  • Entire agreement. These Terms, together with the Privacy Policy and any feature-specific terms, constitute the entire agreement between you and eVaqil regarding the Service.
  • Notices. Legal notices to eVaqil should be addressed to support@evaqil.com.
